Initial appearances to be held on 13 September 2018 in the case of Prosecutor v. Maximilien Turinabo et al.

The initial appearances of Maximilien TURINABO, Anselme NZABONIMPA, Jean de Dieu NDAGIJlMANA, Marie Rose FATUMA, and Dick Prudence MUNYESHULI (Turinabo et al.) are scheduled to be held on Thursday, 13 September 2018, at 13:00 in the courtroom at the Mechanism’s premises in Arusha, United Republic of Tanzania, before Judge Vagn Joensen, the Single Judge assigned to the matter.

The indictment against Maximilien TURINABO, Anselme NZABONIMPA, Jean de Dieu NDAGIJlMANA, Marie Rose FATUMA, and Dick Prudence MUNYESHULI charges two counts of contempt of the ICTR and the Mechanism and one count of incitement to commit contempt of the ICTR and the Mechanism.

Maximilien TURINABO, Anselme NZABONIMPA, Jean de Dieu NDAGIJlMANA, and Marie Rose FATUMA, are accused of having directly and through others, offered bribes and exerted pressure to influence the evidence of protected witnesses in the Augustin Ngirabatware case. Furthermore, the Prosecution alleges that Dick Prudence MUNYESHULI and Maximilien TURINABO knowingly violated the protective measures ordered by the Trial and Appeals Chambers by disclosing the identities of protected witnesses and that Dick Prudence MUNYESHULI had prohibited indirect contact with the protected witnesses in knowing violation of a court order. The alleged aim of these efforts was to secure the reversal of Augustin Ngirabatware’s conviction by the ICTR, as affirmed by the Mechanism’s Appeals Chamber, for direct and public incitement to commit genocide, instigating genocide and aiding and abetting genocide and his sentence of 30 years of imprisonment.
